This Platform serves as a multifaceted marketplace wherein independent Vendors provide a diverse selection of products, thus ensuring a comprehensive shopping experience for all Users.
These Terms of Use delineate the parameters governing browsing, procurement of goods or services, creation of user accounts, registration and operation as a Vendor/Seller, and the utilization of any tools, services, communication channels, or payment systems provided by the Platform.
By virtue of your access to or usage of the Platform, you expressly acknowledge your agreement to abide by these Terms. Should you find any provision unacceptable, please cease all usage immediately.
2. Definitions
- Platform: the website SouthAfricaShop.co.za and its subdomains.
- User: any individual browsing, registering, or purchasing.
- Vendor/Seller: any individual or entity listing or selling goods.
- Buyer: any User purchasing goods.
- Goods: items or services available for sale.
- Account: online profile established for transactions.
- Administrator: management or support personnel overseeing operations.
3. Marketplace Structure
SouthAfricaShop.co.za is a multi‑vendor marketplace where Vendors manage their own products and fulfillment. The Platform facilitates transactions, communication, listings, and buyer protection but does not own or manufacture products unless stated. Vendors are responsible for product quality, compliance, packaging, and customer service. The Platform may mediate disputes but is not the seller of marketplace goods.
4. Acceptance of Terms
- Full acceptance of these Terms and related policies.
- Confirmation of being at least 18 years old.
- Legal capacity to enter into this agreement.
- Providing accurate and lawful information.
- Understanding that electronic communications are legally binding.
5. User Responsibilities
- Comply with laws and regulations.
- Do not disrupt functionality or security.
- Avoid harmful, abusive, or fraudulent content.
- Provide accurate delivery and billing info.
- Use refund, review, and dispute systems appropriately.
- No unauthorized access to accounts or systems.
6. User Account Creation
Users must provide accurate information during registration, safeguard login credentials, and report suspicious activity. The Company may suspend or terminate accounts involved in fraud or policy violations.
7. Vendor/Seller Agreement
7.1 Product Listings
Vendors must provide accurate descriptions, pricing, images, maintain stock, comply with laws, provide delivery timeframes, and honor warranties.
7.2 Fulfillment
Vendors must dispatch orders timely, package securely, use approved couriers, and communicate with Buyers.
7.3 Prohibited Seller Behavior
Vendors may not manipulate reviews, mislead Buyers, unlawfully gather data, or conduct off‑platform transactions to evade fees.
7.4 Vendor Payments
Payouts occur after order confirmation, delivery, and clearance of funds. Chargebacks or disputes may delay payments.
8. Pricing, Payments & Billing
8.1 Pricing
Prices may change without notice and are set by Vendors unless otherwise indicated.
8.2 Payments
Payments are processed through secure gateways (PayFast, Ozow, EFT, cards, wallets). The Platform does not store card information.
8.3 Chargebacks
Chargebacks may result in Vendor liability, order reversal, or temporary suspension of User accounts.
9. Delivery Terms
Delivery depends on Vendor logistics, courier services, and Buyer addresses. The Company is not liable for courier delays, inaccurate addresses, or Vendor delays. Buyers should inspect goods upon delivery and report issues promptly.
10. Returns, Refunds & Cancellations
Vendors must comply with the Consumer Protection Act. Buyers may request returns/refunds for defective, incorrect, misdescribed, or undelivered goods. Refunds depend on Vendor compliance with these stipulations.
